Assumption of Risk, NDA, Non-Compete Clause, Hold Harmless, Indemnity Agreement, & Insurance Waiver Yes
This Agreement ("Agreement") is entered into between The League Of Sportz LLC ("The League"), a company headquartered in Louisville, KY ("Company"), and the undersigned individual ("Employee") as a condition of employment with the Company. 1. Assumption of Risk: Employee acknowledges and understands that employment with The League Of Sportz LLC may involve inherent risks and hazards associated with the nature of the sports, entertainment and recreational activities conducted by the Company. Employee voluntarily assumes all risks and hazards associated with such activities and agrees that the Company shall not be held liable for any injuries, damages, or losses that may arise during the course of employment. 2. Non-Compete Clause: During the term of employment and for a period of [specify duration, e.g., 60 months] following the termination of employment, Employee agrees not to engage in any competitive activities that directly or indirectly compete with the business operations of The League Of Sportz LLC. This includes, but is not limited to, employment or engagement with a competing sports organization or establishment within a [specify geographic area, e.g., 250 miles] radius of Louisville, KY. 3. Hold Harmless and Indemnity Agreement: Employee agrees to indemnify and hold harmless The League Of Sportz LLC, its officers, directors, employees, and agents from any and all claims, liabilities, damages, costs, or expenses, including reasonable attorney's fees, arising out of or related to Employee's actions, omissions, or participation in Company activities, whether on or off Company premises. 4. Insurance Waiver: That it is my responsibility to provide my own health insurance coverage and I fully understand and hereby agree I will provide my own health insurance coverage. I understand and accept the fact that The League does not provide any kind of health insurance, life insurance, or disability insurance for the players or staff of The League. Employee acknowledges that the Company provides no insurance coverage for job-related injuries and incidents. To the extent permitted by law, Employee waives any right to file a claim or lawsuit against the Company for injuries or damages covered by no insurance. Employee is encouraged to obtain personal insurance coverage to supplement any non-company provided insurance. If you choose to get insured through The League it will be deducted from each check during the duration of the season. 5. Governing Law and Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of the state of Kentucky. Any disputes arising under or in connection with this Agreement shall be resolved in the state or federal courts located within the state of Kentucky. 6. Severability: If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. 7. That the aforesaid assumption of risk shall also constitute a waiver of any right, claim, or any other type of cause of action that I might have against The League arising out of working in The League and that such waiver shall extend to and include, not only The League, but also any and all government authorities, including the City of Louisville, Jefferson County, Jefferson County Schools, Metro Louisville Parks & Recreation, and/or private entities that are in any way related to or connected with, either directly or indirectly, the activities of The League in owning and operating a sports League. 8. That in addition to assuming the risk and waiving the liability of the parties named in Paragraph 7 above, I agree to hold harmless and indemnify said parties from and for any and all claims, causes of actions, losses, damages, loss of income, or any other monetary expenses related to or in any way arising out of personal injuries and/or property damages resulting from my participation in any activity whatsoever involving The League and any third parties doing business with The League. 9. To comply with all rules of conduct imposed by The League, both written and unwritten, regardless of when they are imposed, and agree that my failure to comply with such rules of conduct can result in my dismissal from The League at the sole discretion of The League Board of Directors or President of The League. 10. That upon my completion of the season of The League or upon termination of my participation with The League, and its activities for any reason whatsoever, I will buy or surrender within ten (10) days all work equipment received by me from The League, unless gifted. 11. Non-Disclosure Agreement (NDA): Employee agrees to keep confidential and not disclose to any third party any non-public information, trade secrets, salary, pay, bonuses, proprietary information, or other confidential material belonging to The League Of Sportz LLC. This obligation of confidentiality extends beyond the termination of employment. If you move on from The League you CAN NOT take players or staff with you. 12. This is a paid job and must be conducted in a professional manor at all times, even on social media and forfeit any future pay if terminated or duration of suspension. 13. Fines (must be paid before next scheduled event) include but not limited to: - Tech - $50 - Ejected - $100 Acknowledgment IN WITNESS WHEREOF, I have signed this Agreement by selecting my acknowledgement below.
